Terms and Conditions: Ayhan Light Tourism


These Terms and Conditions apply for bookings with Ayhan Light Tourism and organize your rights and responsibilities. By booking you agree to these terms. Please read carefully before booking.


1. Reservation Terms


Your Contract


Your contract is made with Ayhan Light Tourism, a member of TURSAB (TURSAB No: 8774).

1. Your holiday contract

Home When a reservation is made, the “der person” indicated in the booking guarantees that the group accepts these Terms and Conditions on behalf of other persons.

Home After booking and all the required payments arrive at us, the requested arrangements are available, you will receive a confirmation invoice.

Home Once this invoice is sent to the leading person, a binding contract is born. This agreement is subject to Turkish Law and enters the jurisdiction of Turkish Courts.

2. Accuracy of Information

Home It is important to check if the details related to your booking are correct, when you receive the invoice. Please make sure all the details are as you like, especially in late bookings.

Home Please contact us immediately in case of any inconsistencies. It may not be possible to make changes or corrections later.

3. Reservation Changes and Regulations

Home After booking, any changes will be subject to these Terms and Conditions, and the corresponding change will be valid at the time approved by us.

4. Responsibility for Group Members

Home The leader is responsible for the fact that other group members mentioned in the booking are informed of these Terms and Conditions.

Home We assume that all people in your group read and understand these Terms.

Home All people in the booking are considered the side of this contract.

5. Age Limitation

Home The leading person bookings must be 18 years old.


Terms and Conditions


Home These Terms apply for all holiday regulations and enter into force at the time of booking.

2. Website Accuracy


Ayhan Light Turizm strives to ensure the accuracy of information and pricing on the website. However, time errors may occur. Therefore, it is important to check the price and other details about the regulations you choose when booking.


3. Passport, Visa, Health Requirements and Travel Documents


Home Responsibilities: It is your responsibility to ensure that you have all the necessary travel and health certificates before your trip. It is also your responsibility to meet the entry requirements of the countries you go.

Home Passport and Visa Requirements: You must have a valid and full passport for all destinations you will visit (including children). Some destinations may require transit, tourist, business or other types of visas.

Home Check Current Information: Requirements may vary and may vary depending on the time required to get a passport or visa. It is important to check the current information from consults or embassy before your trip.

Home Introduction Reddi: If your entry to any country is rejected due to the lack of your required passport, visa or other documents, Ayhan Light Tourism does not accept any liability in this case.

Home Letter of authorization: In some destinations, children may need a letter of authorization if they are not accompanied by both legal guardians. In this case we recommend you contact the competent authorities of the country.


Recommendation: We recommend that you regularly check the travel alerts, bans and advice that all relevant governments are published before travel.


4. USA Travel Permit (ESTA)


For those who want to travel to the United States or switch to transit over the US, Visa Exemption Program is mandatory to take travel permission. To get a travel permit, you must complete the ESTA (Electronic Travel Permit System) application at least 72 hours before travel.

Home ESTA Fee: Currently, you can visit https://esta.cbp.dhs.gov for application. You can also find detailed information at www.visitusa.org.uk

Home Validity Period: Validated ESTA applies to two years and allows you to visit multiple without applying again.

Home ESTA Almama Status: If the ESTA application is not made, it can be rejected by the airline to the plane.


Health Requirements


Before you travel, you must consult your doctor about the existing vaccination and health requirements for the destinations you will visit.

Home Conformity for travel: Before you travel, you must be sure that your health is convenient to travel and you get the necessary vaccination and medicines.

Home Vaccine and Drugs: You can learn from your doctor about vaccines, medicines and health advice necessary for the country or regions you will travel.

Home Vaccination Blood: While traveling, it is useful to keep up-to-date vaccination records with you, because vaccination proof can be requested for entry to some countries.

Home Responsibility: Ayhan Light Tourism is not responsible for the rejection of your entry to a country or destination as it is missing the necessary health documents or vaccines.


Insurance


Travel insurance is extremely important in terms of safety of your trip.

• Get Insurance: Before traveling, Ayhan Light Tourism, we strongly recommend you and group members to get a suitable travel insurance.

• Fuse Scope: Make sure you meet all your needs, including the insurance policy, health requirements, car rental and other travel regulations you buy.

• Insurance Documents: We recommend that you keep your insurance policy with you during your holiday.


Suggestion: When traveling, take your health and insurance documents to you, will protect you in any case of problems.


5. Your Financial Protection


Ayhan Light Tourism provides full financial protection through TURSAB License number 8774 for your package holidays.

• ATOL Protection: When you purchase holiday including an ATOL protected flight or flight from us, you will be awarded an ATOL Certificate. This certification explains what services are financially protected, what this protection means for you and who should contact with when there is a problem.

Home Alternative ATOL Provider: If we are unable to fulfill the services you provide due to our financial situation, an alternative can provide you with the ATOL owner, the services you purchased or an appropriate alternative (this does not bring you an extra cost).

Home Working with the Alternative ATOL Provider: In this case, you agree that the alternative ATOL owner fulfill these obligations, and the payment required for these services will be made to the alternative ATOL owner.

Home Financial Protection Exceptions: The above-mentioned financial protection is not valid for reservations made out of the package holiday (e.g. only outside the accommodation).


6. Pay Your Holiday


• Reservation Confirmation: To confirm the regulations you choose, you need to pay a non-refundable deposit. This deposit, aircraft tickets in certain types, tours, ship tours etc. It can be higher and will be notified to you during booking.

Home Payment Period: The remaining payment of your holiday should be completed at least 12 weeks prior to the date of time. If this payment is not complete and timely, we will be deemed to cancel your reservation and the cancellation fee (as specified in 9) will expire.

Home Payment Methods: We accept payments with credit card or debit card.


Precautions Against Credit Card Fraud


Home Accurate Information Provided: If you do not provide accurate credit or debit card billing address and/or card holder information, the arrangement of your tickets may be delayed and the total cost may increase.

Home Payment Confirmation and Verification: If your payment is rejected or you provide incorrect credit card information, your holiday may be canceled.

• Random Controls: In order to minimize credit card scam, we reserve the right to make random controls (can include token record). As a result of these controls, before editing your tickets, we can request documents via fax or mail, such as address proof, credit card copier and a final account summary.


7. Your holiday price


7.1 Price Updates: Ayhan Light Turizm pays attention to the latest and accurate prices on the website (guide prices are indicated on our newsletters). However, we reserve the right to make any changes at prices.

Home False Prices: Time time, incorrect price may be shown due to an error. If such an error is noticed, we will notify you as soon as we notice the error or as possible.

• Price Acceptance Status: If you do not want to accept the current price of your holiday, we have the right to cancel your reservation.

7. Price Changes in Packages

For package tours, changes in fees (such as taxes, ports/airport landing fees) may vary after booking. However, the price of your holiday arrangements will not change over 45 days prior to the date of time.


7.3 Price Increase For Package Tours

• Increased up to 2%: If the price of your total holiday arrangement increases up to 2%, we will meet this increase and will not be charged for you. However, if there is an increase on this rate, the more part will be requested with TL 50.00 management fee per person.

• 10% and Top Increase: If the price rise is more than 10% of the price of your total holiday arrangement, you will have the following options:

Home If we recommend you an alternative holiday equivalent or better, you can accept it and no additional fee is charged. However, if the alternative holiday has lower quality, the price difference is returned to you.

Home If the price rise is unacceptable, you can cancel your holiday and withdraw all the paid money, but the exchange fees and cancellation fees will be taken. If you show that you will not be able to use your policy on insurance premiums, a proper refund can be made.

• Right to cancel: If the price rise exceeds 15%, you should use the cancellation rights in this case within 2 days from the date specified in the invoice.


7.4 Price Auction

If the price of your holiday arrangements decreases by more than 2%, in this case you will be refunded to you. However, in some cases, please note that the price changes appear because holiday arrangements are not purchased in the local currency and may not affect the price of your holiday arrangements.


8. Change Your Reservation Status


If you want to make any changes in your trip after receiving your confirmation invoice, Ayhan Light Tourism will do our best to perform these changes, but may not always be able. Change requests must be made by the “previous person” (person who does the reservation). In case of change, additional costs that we encounter during 50 Euro management fee and this change will be requested. If the management fees for our suppliers are higher, we reserve the right to be requested from you.

Home Name Change: If a person in the booking will not travel with a serious cause of the disease, the death of the close relative, the jury service or so on, the name of this person can be transferred to someone else. In this case, we may request a valid document to accept your transfer request. The transfer process can be made at the price of 50 Euro per person and the payment of additional fees.

Home Period For Name Change: The number of name change requests are not guaranteed before the travel date. Most airlines do not change the name after tickets are removed. Therefore, change fees may be requested, including airline fees.

Home Full Name Change: If the name of all people will be changed, this condition is considered cancellation and new booking. In this case, full cancellation fees will apply.

Home Change on dates: Only once per booking the date change may be allowed. When the departure date changes are made, this condition is considered cancellation and the full cancellation fees will be applied. In addition, 50 Euro management fee per person and a new deposit will be requested.

Home Change and Cancellations: Any change to do may require a cancellation fee. Also, some regulations may not change and this may result in the implementation of a 100% cancellation fee.


9. Cancel Your Holiday


You or group members can cancel your trip at any time. In writing of your cancellation request, it is necessary to be made by the “previous person” by mail, fax or email. Due to the cancellation of your holiday arrangements, you will need to pay the cancellation fee indicated below.


Note: If your cancellation reason is included in your insurance policy, you may be able to withdraw these fees from your insurance company.


Cancellation Fees:

Our cancellation fees are determined as a percentage of total holiday costs and are not included in the insurance premium, because the insurance premium cannot be returned. Cancellation fees are determined according to the date we receive the cancellation notice, the date sent by mail is not taken. Please note that the editing fees are not returned. For insurance premium, you should contact the cancellation policy of your insurance provider.


Important Note:

Home If you have booked a Cruise, cancellation or changes (including file changes) will be subject to additional fees set by the relevant ship line, as well as the cancellation changes indicated above.

Home In case of cancellation after receiving documents, there will not be any refunds provided that the unused tickets are sent back.

Home If you cancel only some group members, the cost of holiday for remaining passengers will be recalculated. You may need to pay extra room fees (e.g. single room difference).

Home If the cancellation fees applied by our suppliers are higher than your deposit, this fee may be reflected to you.

• Cancellation Non-exclusive Regulations: Some regulations may not be cancelled after approved, and this may result in a 100% cancellation fee.


10. Change or Cancel Your Holiday


We usually start planning our travel arrangements from month to month and therefore we reserve the right to make changes in holiday details even after bookings are approved. We also reserve the right to cancel approved reservations. For example, if the minimum customer number required for a certain travel arrangement is not reached, we may need to cancel this arrangement. Although most changes are small, sometimes we may have to make big changes.


If we have to make a Great Change or cancel your trip, we will notify you before traveling this situation and if you have enough time, we will offer the following options:

Home Adopting the change-made arrangement,

Home Buying alternative arrangements (if available in the standard similar to the original regulations), (If the alternative arrangement is cheaper, we will return to you, but we will request difference if it is more expensive),

Home We will cancel (or accept cancellation), in this case we will provide you with full and quick refund of all fees you pay for.


However, we will not cancel your holiday for 12 weeks or less, but this rule will apply if you do not make your payment in time due to “Zorner Reasons” (Force Majeure). Due to the unforeseen reasons, we will not pay any compensation, if we need to change or cancel your holiday in order to protect your safety. In this case, we will offer alternative arrangements or refund the fees you paid if you cannot travel, but we will not pay compensation.


In all cases, except for the Great Change and Difficult Reasons, the following compensation payments will be made.


Note: The above payments will be made per passenger who paid full fee (excluding cash). Compensation for children who are billed at discounted price will be paid proportionally to the adult fee. If you do not have a timely payment, the Great Change or cancellation occurs, the above options and compensation rights will not apply.


During your trip, if it is rarely, it may be necessary to change or cancel your editing due to challenging reasons. In this case, we will not pay back, pay compensation, or we will not meet any charges directly formed.


11. 11. Flight


According to EU Law, you have the right to pay and/or compensation from the airline under certain conditions, in case of flight rejection, cancellation or delay. These rights will be announced at EU airports and are also available from airlines. Refund in such cases is the responsibility of the airline company and does not provide an automatic right to withdraw your holiday price. Your refund and/or compensation rights are specified in Article 10.


Due to a reason outside the Reasons, if your main flight is delayed, and if this delay lasts more than 4 hours, we will assure you of light treats; if the delay passes 6 hours, the main meal will be given and longer delays, if possible, meals and appropriate accommodation will be provided.


You may not always be able to verify the carrier, aircraft type and flight hours concerning the flight indefinitely. If we are able to inform only possible carriers at the time of booking, we will inform you that the actual carrier is not informed about any changes in the ID or carrier. The carriers, flight hours and aircraft types mentioned on this website and your confirmation invoice are intended only for guidance and are subject to changes and approval. The latest flight hours will take place on your tickets that will be sent to you about two weeks before the flight date. Therefore, you need to carefully check the flight hours that does not take your tickets. Flight hours, tickets may vary after being sent, in this case, we will inform you as soon as possible when there is a change.


If the carrier(s), flight hours and/or aircraft type changes, these changes do not have the right to switch or cancel any other arrangement provided to pay our regular fees.


This website is our responsibility as your tour operator. Any airline company, which is called here, or used for your trip, does not have any commitment through this website. Also, in accordance with air transportation regulations, remember that a child for baby status should be less than 2 years as of the return flight day.


There is also a Community List available (http://ec.europa.eu/transport/air-ban/list_en.html) and this list contains airlines operating in the EU Community.


12. Home


When you book a holiday with Ayhan Light Tourism, you agree to ensure the right behavior of yourself and your group during the holiday period. If we or any authorized person or service provider considers that any of you or your group will pose a danger to someone else, cause discomfort or cause damage to the goods, the holiday of this person will be terminated immediately. This person will have to leave the plane, accommodation or other services and will not be allowed to participate in the booking travel or use that service. In this case, our or other service provider will not have any responsibility, including return travel regulations. There will not be a refund or any charges incurred due to termination. During the holiday you are responsible for the full payment of damage or loss caused by any of your group. Payment at the time of loss or loss should be made directly to the respective service provider, otherwise you may have to meet the demands made by us, including all the legal costs of our and other party. If we do any costs due to your behaviour, you have to meet these costs completely when we request.


Some service providers may confirm your payment card, room service, phone calls or other hotel services as a deposit for extras, or fee or request a deposit for damages or events incurred during your stay. Some service providers may request cash deposit from non-paid customers. The amount approved or charged may vary significantly depending on the service provider and/or destination. You have enough funds or credit to meet the amount requested by the provider. Ayhan Light Tourism is not responsible for identifying any deposit amount and in case of any questions, you must contact the service provider before travel.


12. August Your Complaint


In case you have any problems with your holiday, you should immediately notify our representative and the related service provider and fill a complaint form in the holiday village. Most problems or complaints can be solved during the holiday, but if not resolved, you can call us from the phone number +90 (532) 783 38 11, send e-mail to Ayhanisikturizminfo@gmail.com or Ayhan Light Turizm, Gülbahçe, Ar- Northkurhan, Ulubatlı Hasan Blv. No:406, 16240 Osmangazi, in writing to Turkey, you can send a letter with all details about your complaint, reservation number and complaint within 10 days from your tour. Please keep your letter short and essence. This will help us quickly identify your concerns and respond faster to you. We also ask you to review 14 items related to the EU. If this procedure is not followed, we will not have the opportunity to research and correct your complaint in the holiday village, and this may affect your rights under the contract.


14 July Status of Your Complaints


Ayhan Light Tourism is a member of TURSAB, membership number is 8774. According to the Rules of Conduct of TURSAB, we are obliged to provide you with high service standard. If your complaint is not resolved, you can use the simple procedure of the EU by visiting www.abta.com. You can also find more information about the help of the EUTA in solving TURSAB’s Code and disputes at www.tursab.org.tr.


15. Our Liability

1. Package Tours Related

We commit that your holiday arrangements will be made with reasonable care and carefulness, fulfillment or provided. This means that we accept our responsibility for our employees, agents or suppliers, for example, if you have to live death or personal injury, or if your contracted arrangement is not provided or missing. Furthermore, our employees, agents and suppliers are under our responsibility when fulfilling their duties or doing what we want to do from them.

2. Other Regulations Related

We are committed to using reasonable care and attention to the fulfillment of our contractual obligations, but these are fulfilled in accordance with these Booking Terms and them. Our contractual obligations cover services such as making your reservation, accommodation/car rental/heat and balloon tour editing, and we act with the same care when choosing our suppliers.

3. Related to Packages and Other Regulations

We do not accept liability for any injury, disease, death, loss, damage, cost, or other demands arising from the following circumstances:


Home Acts or/or actions that the affected person or party members do,

Home The movements or/or movements of a third party without connection with the provided regulations, and if these are unforeseen or inevitable, or they are formed due to “A Reason” (Force Majeure).


4. Scope of Liability

We do not accept any more or different liability than we are responsible for Package Travel, Package Tours and Package Holidays Regulations, except where they are not explicitly specified in these conditions. To make a request with us, it is your responsibility to prove that it is not used for reasonable care and attention.

5. Responsibilities for Carriers and Hotels

If any request or request part (including case or personal injury) is related to any transport arrangement (air, sea, iron road or land carriers) or accommodation in the hotel, the maximum compensation amount we will pay will be limited. For the request or request part in our responsibility, we will pay up to the maximum amount paid under international contract or regulation by carrier or hotelci (such as the Montreal Convention for international air transportation).

6. Local Tours/Events

We do not assume liability for services that are not specified on our website or not included in our contract. For example, any tour or any service that will provide your hotel or any other supplier you will do when you are on holiday. When you are on holiday, local events that you book with through our concierge service or holiday (“Local Events”) are not part of your holiday package and these website conditions are not valid. We are not responsible for the contract, supplier related to such activities.

7. Services and Facilities

The services and facilities included in the holiday are considered reasonable care and carefully, if it fits the applicable local regulations or is reasonable compared to local standards.


16. Data Protection/Privacy


In order to process your reservation and to fulfill your requests, we need to forward your personal information to suppliers that make arrangements related to your trip. We also want to store your information (including your email address) for our future marketing purposes as Travel Cappadocia Agency (for example, to inform you about promotional/match offerings). If you do not want to receive such communications in the future, please let us know as soon as possible. You can contact our privacy policy for full details of our data protection and privacy policy and explanations on how to use your personal information.


17. September Special Demands and Health Problems


If you want to make a special request, you should do this during booking. We will try to forward reasonable demands to the supplier, but we cannot guarantee that the demands will be met. It does not mean that a special request is indicated in your confirmation invoice or other documents, or the supplier is transmitted, the request will be met. If any special request is not met, the contract breach will be considered only if the request is particularly approved. We would like to recommend and help you choose your holiday. Because some accommodation and wheelchair ramp in resorts can be missing from simple facilities such as elevators, it is important to inform us about your disability status and special requirements during booking, to ensure that your holiday fits your specific needs. If we feel reasonably that we may not meet the needs of the relevant person, we will not approve the booking or any information required during the booking, we will cancel the booking after you learned this information.
